REGULATION OF THE DIRECTOR GENERAL OF CUSTOMS AND EXCISE

CONCERNING
CUSTOMS NOTIFICATION ON THE TRANSPORTATION OF GOODS
DIRECTOR GENERAL OF CUSTOMS AND EXCISE,
Considering:
- a. that to fulfill the obligation on the submission and standardization of customs notification on the transport of imported goods, export goods and/or goods of customs areas to other places in customs areas through outside customs areas, it is necessary to set the model and content of customs notification on the transportation of goods as well as guidance to fill it;
- b. that based on the consideration as described in paragraph a., to implement provisions in Article 11 of Regulation of the Finance Minister No. 155/PMK.04/2008 concerning Customs Notification, it is necessary to stipulate Regulation of the Director General of Customs and Excise concerning Customs Notification on the Transportation of Goods;
In view of:
- 1. Law No. 10/1995 concerning Customs (Statute Book No. 75/1995, Supplement to Statute Book No. 3612), that is amended by Law No. 17/2006 (Statute Book No. 93/2006, Supplement to Statute Book No. 4661);
- 2. Law No. 11/1995 concerning Excise (Statute Book No. 76/1995, Supplement to Statute Book No. 3613), that is amended by Law No. 39/2007 (Statute Book No. 105/2007 Supplement to Statute Book No. 4755);
- 3. Regulation of the Finance Minister No. 100/PMK.01/2008 concerning the Organization and Work Mechanism of the Finance Ministry that is amended by Regulation of the Finance Minister No. 149/PMK.01/2008;
- 4. Regulation of the Finance Minister No. 155/PMK.04/2008 concerning Customs Notification;
HAS DECIDED:
To stipulate:
REGULATION OF THE DIRECTOR GENERAL OF CUSTOMS AND EXCISE CONCERNING CUSTOMS NOTIFICATION ON THE TRANSPORTATION OF GOODS.
CHAPTER I
GENERAL PROVISIONS
Article 1
In this Regulation:
- 1. "Customs Law" refers to Law No. 10/1995 concerning Customs that is amended by Law No. 171/2006.
- 2. "Customs obligations" refers to all activities in the customs field that must be carried out to fulfill provisions in the Customs Law.
- 3. "Customs notification on the transportation of goods" refers to statement made by transporter operator to fulfill customs obligations with the model and conditions set by the Customs Law.
- 4. "Electronic data" refers to information or a set of information compiled and/ or gathered for special use, received, recorded, sent, stored, processed, withdrawn, or produced electronically using computers or electronic data processing instruments, optics or other similar means.
- 5. "Customs Office" refers to the office of the Directorate General of Customs and Excise where customs obligations are met according to the Customs Law.
- 6. "Transporter operator" refers to persons their proxies, or those responsible for operating transporter carrying goods and/or people.
- 7. "Transporter" refers to sea, air or land vehicles used to transport goods and/or people.
- 8. "Port" refers to seaport and airports.
- 9. "Inward plan of transporter" refers to a notification on the inward plan of transporter sent by transporter operator to a customs office.
- 10. "Inward schedule of transporter" refers to a notification on the inward plan of transporter with regular indward schedule in a certain period oftime, sent by transporter operator toa customs office.
- 11. "Inward manifest of transporter" hereinafter called as inward manifest, refers to a list of commercialcargoescarried by sea,air and land transporterat the time of entering a customs area.
- 12. "Outward manifest of transporter" hereinafter called as outward manifest, refers to a list of commercial cargoes carried by sea, air and land transporter at the time of leaving a customs area.
Article 2
Customs notification on the Transportation of Goods consists of:
- a. Notification on the inward plan of transporter/inward schedule of transporter (RKSP / JKSP);
- b. Notification on inward manifest/outward manifest;
- c. Notification on the release of imported goods from a customs area to a temporary stackin yard in other customs area;
- d. Notification on the Transportation of Goods of customs area from one place to another through outside a.customs area.
Article 3
The notification as described in Article 2 can besent in the form of writing on the paper or in the form of electronic data.
Article 4
(1) The notification as described in Article 2 shall be filled using Indonesian language, Latin character and Arabic numbers.
(2) The notification as described in paragraph (1) can use English when it comes to inward manifest/outward manifest.
CHAPTER II
NOTIFICATION ON THE INWARD PLAN OF TRANSPORTER/INWARD SCHEDULE OF TRANSPORTER
Article 5
(1) Notification on the inward plan of transporter/inward schedule of transporter as described in Article 2 a uses code BC.1.0.
(2) The notification form as described in paragraph (1) shall:
- a. use A4 paper (8.3 x 11.7 inch), letter paper (8.5 x 11.0 inch), legal paper (8.5 x 14.0 inch), or foolscap-sized paper (8.5 x 13.0 inch);
- b. consist of a copy for the customs office.
Article 6
The model, content and filling guidance of the inward plan of transporter/inward schedule of transporter shall follow Attachment I which is an integral part of this Regulation of the Director General.
CHAPTER III
NOTIFICATION ON INWARD MANIFEST/OUIWARD MANIFEST OF TRANSPORTER
Article 7
(1) Notification on inward manifest/outward manifest as described in Article 2 b uses code B.C. 1.1.
(2) The notification form as described in paragraph (1) shall:
- a. use A4 paper (8.3 X 11.7 inch), letter paper (8.5 x 11.0 inch), legal paper (8.5 x 14.0 inch), or foolscap-sized paper (8.5 x 13.0 inch); and
- b. consist of a copy for a customs office.
Article 8
(1) Transporters can decide themselves the model of BC 1.1. form for land transporter.
(2) The BC 1.1 form as described in paragraph (1) shall at least contain:
- a. car registration number;
- b. name of transporter operator (individual/ company);
- c. place/ country of origin;
- d. destination;
- e. date of arrival;
- f. sequence number;
- g. name and address of supplier;
- h. name and address of recipient;
- i. the number and type of packages/containers;
- j. description of goods;
- k. gross weight and/or size/volume of goods;
- I. remarks;
- m. full name of transporter operator.
Article 9
The model, content and filling guidance of notification on inward manifest/outward manifest for sea and air transporter shall follow attachment II which is an integral part of this Regulation of the Director General.
CHAPTER IV
NOTIFICATION ON THE RELEASE OF IMPORTED GOODS FROM A CUSTOMS AREA TO TEMPORARY STACKING YARD IN OTHER CUSTOMS AREA
Artide 10
(1) Notification on the release of imported goods from a customs area to a temporary stackin yard in other customs area as described in Article 2 c uses code BC 1.2.
(2) The notification form as described in paragraph (1) shall:
- a. use A4 paper (8.3 X 11.7 inch), letter paper (8.5 x 11.0 inch), legal paper (8.5 x 14.0 inch), or foolscap-sized paper (8.5 x13.0 inch);
- b. consist of a notification sheet and can be accompanied by a continued sheet when BC 1.2. contains more than one descriptions of goods; and
- c. be made in 3 (three) copies for:
- 1. the customs office of destination sent along with goods;
- 2. the customs office of destination sent by mail; and
- 3. the customs office of origin.
Article 11
The model, content and filling guidance of notification on the release of imported goods from a customs area to a temporary stackin yard in other customs area shall follow attachment III which is an integral partofthis Regulation of the Director General.
CHAPTER V
NOTIFlCATION ON THE TRANSPORT OF GOODS OF CUSTOMS AREA FROM ONE PLACE TO ANOTHER THROUGH OUTSIDE OF CUSTOMS AREA
Article 12
(1) Notification on the transportation of goods of customs area from one place to another through outside a customs area as described in Article 2 d shall use code BC 1.3.
(2) The notification form as described in paragraph (1) shall:
- a. use A4 paper (8.3 X 11.7 inch), letter paper, (8.5 x 11.0 inch), legal paper (8.5 x 14.0 inch), or foolscap-sized paper (8.5 x 13.0 inch);
- b. consist of a notification sheet and can be accompanied by a continued sheet when BC 1.3. contains more than one descriptions of goods; and
- c. be made in 3 (three) copies for:
- 1. the customs office of destination sent along with goods;
- 2. the customs office of destination sent by mail; and
- 3. the customs office of origin.
Article 13
The model, content and filling guidance of notification on the transportation of goods of customs area from one place to another through outside a customs area shall follow attachment IV which is an integral part of this Regulation of the Director General.
CHAPTER VI
TRANSITIONAL PROVISIONS
Article 14
Customs notification of transportation are:
- a. Notification on the inward plan of transporter/inward schedule of transporter (RKSP/JKSP) and notification on inward manifest/outward manifest is an integral part of this Regulation of the Director General;
- b. Notification on transhipped imported goods using code 1.2 according to Attachment VI which is anintegral part of this Regulation of the Director General; and
- c. Notification on the Transportation of Goods of customs area from one place to another through outside a customs area according to Attachment VII which is an integral part of this Regulation of the Director General; shall be made retroactive to December 26, 2008 until this Regulation of the Director General comes into force.
CHAPTER VII
CLOSING
Article 15
This Regulation of the Director General shall come into force 60 (sixty) days after the date of stipulation.
